Collection of two original documents relating to an appellate court case involving defendant Gustave Majoine ("Criminal No. 1140"), convicted of burglary. The documents are a Respondent's Brief (beige paper wrappers with staple binding, nine pages) and a Transcript on Appeal (gray paper wrappers, 195 pages). The Transcript has some handwriting in ink and pencil and a red "Sacramento Office Copy" stamp on front cover. Both documents have a date of 1904. Both documents are 7" x 10." Respondent's Brief is very clean and intact except for slight age toning and minuscule bumping to corners and top edge of front cover. Transcript on Appeal is very clean and intact except for slight age toning, a crease along front outer joint on front cover, and a small closed tear at tail of spine. Binding is tight for both documents. Each document and the entire collection are Very Good. Collection of two original documents relating to the appellate case, "The People of the State of California vs. Gustave Majoine," in which Majoine appealed his conviction and fifteen-year prison sentence at San Quentin for the crime of "burglary of the first degree." Attorneys for Majoine were M. Walter Dinkelspiel, Benjamin I. Block, and J. M. Mannon, Jr. Attorneys for the People of California were U. S. Webb and J. C. Daly. Both documents were filed by Clerk Frank C. Jordan. For the original case, William P. Lawlor was the judge and Raymond M. Aguirre served as the interpreter. The following is a summary of the items in the collection. 1) "Criminal--No. 1140, In the Supreme Court of the State of California. The People of the State of California, Plaintiff and Respondent, vs. Gustave Majoine, Defendant and Appellant. Appeal from the Superior Court of the City and County of San Francisco. Respondent's Brief." A printed brief summarizing the arguments made against Majoine and his appeal. 2) "Criminal No. 1140, In the Supreme Court of the State of California. The People of the State of California, Respondent, vs. Gustave Majoine, Appellant. Transcript on Appeal." A printed transcript of the original case, "The People of the State of California vs. Gabriel Giraud and Gustave Majoine." The transcript includes direct and cross examinations of the witnesses, including Alexander Bailly, a French baker and the victim of the crime. The testimonies shed light on further details of the crime. Giraud and Majoine had worked for a Bailly at his bakery on 822 Montgomery Street in San Francisco. Bailly had a safe with money in it at his bakery but found it stolen one day. The safe was later found outside by a policeman with all of its money missing. Many of the testimonies implicate Giraud and Majoine as perpetrators of the crime. The jury found both Giraud and Majoine guilty of burglary of the first degree in 1903, and they were both sentenced to fifteen years in San Quentin. Motions for a new trail were denied for both as well. Majoine filed an appeal but Giraud did not.. Ephemera. Book Condition: Very Good. Binding: No Binding

The Transcript has some handwriting in ink and pencil and a red "Sacramento Office Copy" stamp on front cover. Both documents have a date of 1903. Both documents are 7" x 10." Respondent's Brief is very clean and intact except for slight darkening, browning, and minuscule wear to extremities. Attorneys for Stevens were Milton A. Nathan and Richard P. Henshall. Attorneys for the People of California were U. S. Webb and C. N. Post. Both documents were filed by Clerk Frank C. Jordan. A printed transcript of the original case, "The People of the State of California vs. Francis Stevens." The transcript includes direct and cross examinations of the witnesses, including Morres Aronstein, the victim of the crime. The testimonies shed light on further details of the crime. In August 1902, Aronstein had met Stevens, whom he had previously been acquainted with, in San Francisco's Union Square Park to socialize for the evening. Aronstein treated Stevens to drinks and a play at the Alcazar Theater. After the play, Stevens invited Aronstein to his room at No. 144 Fifth Street to show him some gold ore specimens he claimed to have. Aronstein had expressed his personal interest in mining to Stevens. However, once they were at Stevens's room, Stevens insisted that Aronstein stay overnight at his place as it was late. Aronstein had fallen asleep but was awakened when he was accosted by Stevens who, at that point, was standing over Aronstein and brandishing a razor. According to Aronstein, Stevens then verbally threatened to kill him with the razor and demanded that Aronstein give him his money. Aronstein gave up his money and managed to escape and alert a police officer. Upon returning to Stevens's room with the officer, Aronstein was able to get some of his money back, but Stevens had taken the rest. In the original case, Stevens claimed that he had threatened Aronstein with a razor because the latter had made to perform an "unnatural act" upon him (implying that Aronstein was homosexual) which the jury dismissed. The jury found Stevens guilty of felony robbery, and he was sentenced to five years in San Quentin.. Ephemera. Book Condition: Very Good. Binding: No Binding
