The petition, jointly submitted by the state and the attorney for Fred Bose, describes Bose's conviction of child molestation in a Sacramento County court, his sentence to ten years in a Folsom prison, and his request for a new trial denied by the Third District Court of Appeals. The petition asks for a new trial before the Supreme Court. The alleged incident for which Bose ("an older man") was convicted took place on a park bench outside of an amusement park in Oak Park, Sacramento in the summer of 1914. The incident involved a twelve-year-old girl. Some testimony and summary of the testimony from the original trial are included. Both the state and Bose's attorney, R. P. Talbot, argue for a new trial because they believe the young girl's accusations are "improbable," that the jury acted out of "passion and prejudice," and that both judges and the prosecuting attorney were guilty of incompetence and misconduct..
