Original publisher's beige wrapper with staple binding. August 10, 1950. 5 7/8" x 9 1/8." Eleven pages, complete. Very slight wrinkling at the edges. Staples are rusted internally. Pages are very clean and intact. A fine copy. Court proceedings against Philip Bart, who was interrogated after being subpoenaed by the Committee on Un-American Activities (HUAC). HUAC was a committee under the House of Representatives formed in 1938 to investigate citizens and organizations thought to have Communist or Fascist ties. These proceedings took place in 1950 at the height of the Red Scare during the Cold War when McCarthyist tactics were common. Philip Bart was a general manager of the Daily Worker, a Communist newspaper, and Freedom of the Press Company, which published the newspaper. Bart was asked a series of questions regarding his role as an organizer of the Communist Party in Ohio, his last name, his citizenship status, passport, persons of interest, and the like, but he refused to answer many of them citing the Fifth Amendment of the Constitution. Bart was indicted on thirty-two counts of contempt for not answering that number of questions but was convicted on eight counts after twenty-four were dismissed. In Bart v. United States (1955), the judgment of Bart was reversed with directions to the District Court to enter a judgment of acquittal based upon the findings that Bart was not properly informed as to whether he definitively had to answer the questions or not and thus could not be held in contempt of the court. The cases of Quinn v. United States and Emspak v. United States were used as precedents for this case.. Book. Book Condition: Fine. Binding: Soft cover
